The term “Habeas Corpus” means “produce the body”. Whenever a person is detained illegally by the instrumentalities of the state or by a private individual either due to the negligence or the connivance of the instrumentalities of the state, a friend of the detenue or his relatives or any person interested in the welfare of the detenue can approach the High Court under Article 226 or the Supreme Court under Article 32 of the Constitution of India to file a petition for a writ of Habeas Corpus and the detenue will be set at liberty.
